Quy định của pháp luật về thẻ tạm trú

Thẻ tạm trú được hiểu đơn giản là một loại giấy tờ do cơ quan nhà nước có thẩm quyền của Việt Nam cấp cho những đối tượng người nước ngoài được phép tạm trú tại Việt Nam theo quy định của pháp luật hiện hành.

Để được cấp thẻ tạm trú thì người nước ngoài phải đáp ứng được những điều kiện nhất định sau đây:

– Tuân thủ đúng quy định của pháp luật Việt Nam về xuất nhập cảnh như có đầy đủ hộ chiếu, thị thực;

– Có nơi tạm trú hợp pháp: Việc xác định nơi tạm trú của người nước ngoài tại Việt Nam sẽ thông qua các giấy tờ chứng minh quyền sử dụng hợp pháp; nơi có giấy phép đảm bảo đủ điều kiện cho người nước ngoài thuê; đã đăng ký tạm trú và được cấp sổ tam trú hoặc giấy chứng nhận tạm trú;

Hiện nay có 2 nhóm đối tượng chính được phép cấp thẻ tạm trú tại Việt Nam đó là:

– Người nước ngoài là thành viên thuộc cơ quan đại diện ngoại giao, cơ quan lãnh sự, cơ quan đại diện tổ chức quốc tế thuộc Liên hợp quốc, tổ chức Liên chính phủ tại Việt Nam và gia đình của họ bao gồm vợ/chồng, con dưới 18 tuổi, người giúp việc cùng đi theo nhiệm kỳ thì sẽ được cấp thẻ tạm trú với ký hiệu là NG3;

– Người nước ngoài thuộc những trường hợp khác được cấp thị thực với ký hiệu gồm: LV1, LV2, ĐT, NN1, NN2, DH, PV1, LĐ, TT thì sẽ được xem xét và cấp thẻ tạm trú có ký hiệu tương ứng với ký hiệu trên thị thực của họ.

Về thời hạn tạm trú thì được quy định như sau:
– Thẻ tạm trú có ký hiệu là NG3, LVQ, LV2, ĐT và Dh thì thời hạn tạm trú không quá 5 năm;

– Thẻ tạm trú có ký hiệu NN1, NN2, TT thì thời hạn tạm trú không quá 3 năm;

– Thẻ tạm trú có ký hiệu LĐ, PV1 có thời hạn không quá 2 năm;

Ngoài ra, trường hợp thẻ tạm trú hết thời hạn thì có thể làm hồ sơ đề nghị để được cơ quan nhà nước có thẩm quyền xem xét cấp lại.
